Exergen Corporation, a leader in temperature measurement technology, has filed a lawsuit against Baxter International Inc. in the United States District Court for the District of Massachusetts. The legal action comes in response to Baxter's attempts to suppress factual statements made by Exergen regarding the accuracy of oral thermometers, as published in a scientific journal.

The lawsuit asserts Exergen's right to free speech under the First Amendment and seeks legal affirmation that the statements made by Exergen are both true and constitutionally protected. Exergen is committed to defending its ability to disseminate truthful information on matters of public concern.

"We firmly believe in the accuracy and integrity of our statements regarding oral thermometers," stated a spokesperson for Exergen. "We are confident that our position will be vindicated in a court of law."
